Terms and Conditions
Acceptance of Terms and Conditions:
These terms and conditions govern the provision of goods and services (“products”) by Airline Flying Club Incorporated (“Flight Training Auckland,” “we,” “us,” “our”) to you, the purchaser of such goods and services, including your use of the website located at https://www.flighttrainingauckland.co.nz (“the website”). These terms are effective from 9 February 2025 and supersede all previous terms of trade established by Airline Flying Club Incorporated, as well as any conditions outlined in documents you may have used that claim to have contractual significance.
We reserve the right to amend these terms of trade and will notify you of any changes. Such notice may be provided by posting the updated terms and conditions on our website, through our newsletter, or by any other effective communication method.
You must be at least 18 years old to purchase an introductory flight “Trial Flight”.
If you are making a purchase on behalf of another entity, such as a corporation or person, you affirm that you possess the authority to accept these terms and conditions on behalf of that entity.
Flight Details:
Typically flights are around 50 mins from the time you finish your briefing to the time you arrive back at the apron.
Briefing takes around 30 minutes.
Aircraft Availability:
All flights are contingent upon the availability of our aircraft. In the event that our aircraft is unavailable for any reason, we will make every effort to inform you of this unavailability via text message and/or email. Airline Flying Club Incorporated shall not be held liable for the unavailability of aircraft due to weather conditions, maintenance issues, or any other factors related to the safe and secure operation of an aircraft.
General Health Conditions:
You confirm that you possess a standard level of fitness and do not have any underlying health conditions that could be exacerbated by participating in a trial flight.
Cancellations and Refunds:
Should your flight be cancelled due to weather or illness, whether on your part or that of the pilot, we will provide the option to rebook at no additional charge. For introductory flights, referred to as “Trial Flights,” please be aware of the following:
Flight Credit:
The value of your trial flight will become void three months after the date of purchase.
Expiry:
Any unused purchases will become invalid three months from the date of purchase and will no longer be eligible for redemption.
Refunds:
Refunds for Trial Flight purchases may be granted at the discretion of the Airline Flying Club Incorporated Committee.
A fee of $50.00 will be charged for processing refunds related to Trial Flights, which will be deducted from the total refund amount.
Pricing:
All prices are quoted in New Zealand Dollars and include any applicable Goods and Services Tax (“GST”), unless otherwise specified, but do not include delivery charges. Prices are accurate at the time of publication, and we reserve the right to change them at any time. An invoice will be sent to the email address provided during the order process.
It is your responsibility to ensure that your contact information is accurate.
Payment Security:
All transactions are processed through Stripe’s secure payment system, ensuring a high level of payment security and are subject to Stripe’s terms and conditions.
Liability Limitation:
To the fullest extent permitted by law, we disclaim all liability to you “THE PURCHASER” OR “PASSENGER” for any claims, except in cases of bad faith on our part. This disclaimer also extends to all officers, employees, contractors, agents, or pilots associated with us, as well as any other individuals engaged to perform our obligations or provide services under any agreement with you. None of the aforementioned individuals shall be liable or required to compensate you for any issues arising from their actions, omissions, or delays, regardless of whether such actions were anticipated or authorized by any agreement with us. This disclaimer applies to all types of claims and potential liability.
However, it does not affect any rights you may have under the Consumer Guarantees Act 1993 that cannot be legally excluded or modified.
